ok, let's try "old school" method ,
edit this file templates/gk_bikestore/html/com_virtuemart/cart/default.php

line 184 -- add there your link to article with TOS.

In meantime I will try to find a good solution.

p.s.
I have checked forum.virtuemart.net and it looks like VM bug.
Many people have this same problem as you, even when they are using default templates.

But when I update BikeStore template to the latest version is started to working again.
So maybe try ...

yes i can...but I have too much work and modifications that will look the same as now
